19 Texas Administrative Code § 89.1040. Eligibility Criteria.

(c) Eligibility definitions. 
   ... 
 (4) Emotional disturbance. A student with an emotional disturbance is one who has been determined to meet the criteria for emotional disturbance as stated in 34 CFR, §300.8(c)(4). The written report of evaluation shall include specific recommendations for behavioral supports and interventions.

20 The United States Code §1401. Definitions.   A tendency to develop physical symptoms or fears associated with personal or school problems;

Except as otherwise provided, in this chapter:       

(3) Child with a disability         
 (A) In general           
The term "child with a disability" means a child -             
      (i) with intellectual disabilities, hearing impairments (including deafness), speech or language impairments, visual impairments (including blindness), serious emotional disturbance (referred to in this chapter as "emotional disturbance"), orthopedic impairments, autism, traumatic brain injury, other health impairments, or specific learning disabilities; and             
      (ii) who, by reason thereof, needs special education and related services.
